Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade—Notification of Final Regulatory Action Pursuant to Section 100E(7) of the Industrial Chemicals (Notification and Assessment) Act 1989

Australia has ratified the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, (the Convention). At its sixth meeting, 28 April to 10 May 2013, the Conference of the Parties to the Convention agreed to list certain industrial chemicals in Annex III of the Convention. Annex III includes chemicals that are subject to the Prior Informed Consent (PIC) procedure under the Convention. Subsequent to the domestic ratification of the listing of additional chemicals in Annex III of the Rotterdam Convention, amendments have been made to regulation 11C(1) of the Industrial Chemicals (Notification and Assessment) Regulations 1990 (the regulations). The regulations prohibit the introduction and export of the chemicals specified below without written authorisation from the Director of the National Industrial Chemicals Notification and Assessment Scheme (NICNAS). Import and export controls on industrial chemicals subject to the PIC procedure are also enforced under section 106(2) of the Industrial Chemicals (Notification and Assessment) Act 1989. The additional chemicals are illustrated in the table below:
