Spain Poison Centre Notification Deadline to be Postponed until June 1, 2024 for Hazardous Mixtures Intended for Industrial Use

On 31 May 2017, the Ministry of Justice issued a proposal under Order JUS/XXX/2017 aimed at updating the procedure for notifying chemical products to the National Toxicological and Forensic Sciences Institute (INTCF). It has been made to incorporate regulatory progress made by Commission Regulation (EU) 2017/542 of 22 March 2017, amending Regulation (EC) No 1272/2008 of the European Parliament and of the Council on classification, labelling and packaging of substances and mixtures, adding Annex VIII on harmonised information relating to emergency health response. All due notifications are currently regulated under Ministerial Order JUS/836/2013 of 7 May 2013 as amended by Order JUS/992/2015, relating to the registration, withdrawal and modification of toxicological information to the chemical products registry administered by the Toxicological Information Service of the National Institute of Toxicology and Forensic Sciences (INTCF). The Draft Order would enable manufacturers, importers and downstream users, placing on the Spanish market hazardous chemical mixtures for industrial use only, to delay notifications as an optional communication procedure until 1 June 2024. This would apply to mixtures which had to be notified by 1 June 2017, in accordance with the transitional notification procedure established under Order JUS/992/2015. As part of the optional communication, notifiers would need to submit a simplified set of documentation, including: Safety Date Sheet (SDS); and Label or identification document of the chemical mixture Those eligible for this optional communication would be exempted from the standard notification fee payment, regulated under Chapter II of this Order. The optional communication procedure would not apply in the event of displaying the Toxicological Information Service Emergency Telephone Number +34 91 562 04 20 on Section 1.4 of the SDS or on the label of the chemical mixture. The existing Ministerial Order JUS/836/2013 of 7 May 2013 would be revoked upon the entry into force of the proposed Order.
