U.S. EPA publishes list of substances reported under the TSCA Inventory Notification (Active-Inactive) Rule

On 22 November 2017, the United States Environmental Protection Agency (EPA) released a preliminary list of chemical substances reported under the Toxic Substances Control Act (TSCA) Inventory Notification (Active-Inactive) Rule. This list includes substances reported to the U.S. EPA as of 10 November 2017, and will be updated approximately once per month. The TSCA Inventory Notification (Active-Inactive) Rule requires industry reporting of chemicals manufactured/imported in the U.S. during the 10-year time period ending on 21 June 2016, through the submission of a new “Notice of Activity” (NOA) Form A. The reporting period for manufacturers/importers ends on 7 February 2018, and the reporting period for processors ends on 5 October 2018. Substances identified on the ‘NOA reported’ list are not exempt from retrospective reporting by other manufacturers under the rule, unless a manufacturer has obtained a CDX receipt documenting the U.S. EPA’s receipt of an NOA Form A from another person for the chemical substance.
