U.S. EPA updates List of Chemicals Subject to TSCA Section 12(b) Export Notification Requirements

The United States Environmental Protection Agency (EPA) has published the latest version, current to 1 November 2017, of the List of Chemicals Subject to TSCA Section 12(b) Export Notification Requirements. 21 substances were added and 33 substances were deleted. Under section 12(b) of the Toxic Substances Control Act (TSCA), exporters of chemicals subject to certain TSCA regulations are required to send an export notification to the U.S EPA. The U.S EPA then provides information regarding the exported chemical to the importing government. Notification of export is required for chemicals and mixtures for which:

  • The submission of data is required under TSCA section 4 or 5(b);
  • An order has been issued under TSCA section 5;
  • A rule has been proposed or promulgated under TSCA section 5 or 6; or
  • An action is pending, or relief has been granted under TSCA section 5 or 7.
